Election and Campaign Rules for NOLSW/UAW Local 2320 Offices

1. CONSTITUTION AND BYLAWS

The nomination and election of Local 2320 will be conducted in accordance with the International Consitution, the Local 2320 bylaws; and the Labor-Management Reporting and Disclosure Act of 1959, as amended.

2. TERM OF OFFICE

The officers elected will serve a three-year term, which will end when new Officers are sworn in. Installation of new officers will occur on or around November 30, 2010.

3. ELIGIBILITY TO HOLD OFFICE

As provided in Article 38, Section 3 of the International Constitution, no member shall be eligible for election as an Executive Officer of the Local Union until s/he has been a member in continuous good standing in the Local Union for one (1) year immediately prior to the nomination, except in the case of a newly organized local unit.

4. CANDIDATE ELIGIBILITY DETERMINATIONS

The Election Committee will review Local 2320 dues records to determine the eligibility of all nominees. Eligible nominees will be notified of their eligibility, given a copy of these rules, and asked how they wish their names to appear on the ballot. Ineligible nominees will be advised of the reason(s) they are not eligible to run for office.

5. TELEPHONE CONFERENCE WITH CANDIDATES

In lieu of a face-to-face meeting a conference call will be arranged with the Election Committee and the candidates to discuss election procedures, inspection of the Local Union's membership list, and distribution of campaign literature, challengers, and other campaign rules. In the course of this telephone conference, a drawing will be held to determine the order in which the names of the candidates will appear on the ballot.

6. INSPECTION OF THE MEMBERSHIP LIST

Each candidate may inspect (not copy) the Local 2320 membership list once within 30 days prior to the election. No candidate may receive a copy of the list.

Inspection of the membership list will be arranged with at least two Election Committee representatives present. Any candidate who wishes to inspect the list should contact Diane Lanigan in the national office of UAW Local 2320 at 212-228-0992 or 800-UAW-2320.

7. DISTRIBUTION OF CAMPAIGN LITERATURE

Local 2320 will honor any reasonable request by a candidate to distribute campaign literature to members at the candidate's expense. Requests will be honored in the order received. Campaign literature must be provided to the national office of Local Union 2320, in sealed, stamped envelopes, which are ready for mailing. Each candidate should check with postal officials to determine the ' proper postage. ­Candidate must pay $60.00 in advance for each mailing to cover the cost of address labels. Arrangements have been made for Local 2320 office staff to put address labels on the envelopes containing campaign literature at a rate of $20.00 per hour. Candidate should contact the Local Union at (212) 228-0992 to arrange for mailings.

 If the Local Union requires the use of a commercial mailing house, the candidate must meet the deposit and bear the full costs of the mailing, as well as meeting other market requirements of the vender.

 8. CAMPAIGN RESTRICTIONS

Federal law prohibits the use of any Local Union or employer funds to promote the candidacy of any person in a Local Union Officer Election. This prohibition applies to cash, facilities, equipment, vehicles, office supplies, etc., of Local 2320 and any other Union, and of employers whether or not they employ Local 2320 members. Union officers and employees may not campaign on time paid for by the Local Union.

All campaign expenses incurred by candidates including telephone calls, leaflets, envelopes, stationary etc. must be receipted and made available to the Election Committee upon request.

Federal law also provides that candidates must be treated equally regarding the opportunity to campaign and that all members may support the candidates of their choice without being subject to penalty, discipline, or reprisal of any kind.

9. VOTER ELIGIBILITY

As provided in Article 38, Section 10(a) of the International Constitution, "Every member in good standing shall be entitled to vote at all Local Union Elections." Also, as per Article 6, Section 4, "Upon acceptance of the application, membership shall date from the first day of the month for which dues are paid or dues check-off is authorized." Voter eligibility will be confirmed by the Election Committee Chairperson during the ballot tally on November 5, 2010.

10. ELECTION NOTICE

A NOTICE OF ELECTION will be mailed to the last known home address of each Local 2320 member and retiree on October 11, 2010 (see Section 12 below). Election notices will also be posted on Local Union bulletin boards at all work sites and Local 2320 offices.

11. CHALLENGERS

Candidates are entitled to have challengers present at the pick up and tally of mail ballots. Challengers must be members of Local 2320, as required by Article 38, Section 120(g) of the International Constitution, which also prohibits candidates from serving as challengers. Candidates should submit the names of the challengers in writing to Election Chairperson at least two days prior to election day.

12. THE ELECTION

The election will be conducted by mail. A Mail Ballot Package will be mailed to the last known home address of each Local 2320 member and retiree on or before October 11, 2010. The Mail Ballot Package will include the following: a) Notice of Election and Instructions for Mail Voting; b) Secret Ballot Envelope, used by the voter to enclose the marked ballot; c) Return Ballot Envelope, used by the voter to return the Secret Ballot Envelope with the marked ballot sealed inside; d) the Ballot. Two separate post office boxes will be established, one for Mail Ballot Packages that are returned as undeliverable, and one for voters to send the Return Ballot Envelopes.

Ballots Must Be Received (Not Postmarked) at the Post Office by November 4, 2010

13. TALLY OF BALLOTS

Envelopes containing the voted ballots will be picked up from the post office on November 5, 2010 at approximately 12:00 noon, and immediately transported and tallied by the Chairperson of the Election Committee at the Local 2320 office, 256 West 38th Street, New York, New York. Candidates may have a challenger present at the pick up and at the tally.

Write-in votes are not permitted in the election, and pursuant to Article 38, Section 2 of the International Union Constitution, Executive Officers require a majority vote. In accordance with Article 38, Section 5 of the International Union Constitution, other officers are elected by a plurality, unless the Local Union’s bylaws require a majority.

14. ELECTION RESULTS

Election results will be posted on the NOLSW Local Union 2320 web-site, and at local work sites.

15. ELECTION RECORDS

The Local 2320 Recording Secretary and/or Election Committee are responsible for maintaining all nomination and election records for at least one year after the election, as required by federa11aw and Article 38, Section 12 of the International Constitution.

16. QUESTIONS OR PROBLEMS

Candidate and members with questions about the nomination or election procedures should contact the Chairperson of the Election Committee, Dwight Loines at 917-592-5763. Any violation of these rules should be reported promptly to the Election Committee so that corrective action can be taken, if necessary.

17. PROTESTS

Article 38, Section 11 of the International Constitution provides that any member may challenge a Local Union Officer Election by filing a protest. In accordance with Article 38, Section 11 following the election, the Election Committee shall report in writing the canvass of the results of the election to the membership through the local unit leadership. No protest to an election shall be considered unless raised within seven (7) days of the date the written canvass is posted. A protest must be in writing and must be actually received by the Local Union Recording Secretary at the national office of Local 2320 (256 West 38th Street, Suite 705,  New York, N.Y. 10018) before the deadline.

The aforementioned rules are not all inclusive. Additional election rules or clarifications may be issued by the Local 2320 Election Committee as needed during the nomination and election period.
