NOLSW/UAW Local 2320 Elections: Use of Union and Employer Funds

Dear Brothers/Sisters:


Since the campaign period for the election of NOLSW/UAW Local 2320 officers is beginning, as the Chairperson local unions Election Committee I need to advise you of certain restrictions on the use of employer and union funds for campaign purposes

Section 401(g) of the Labor-Management Reporting and Disclosure Act of 1959, as amended, prohibits the use of union and employer funds and resources to promote the candidacy of any person in a union officer election. The prohibitions apply to facilities, equipment, supplies and cash, as well as campaigning on time paid for by either the union or employer, or the use of union or employer newsletters and email addresses for campaign purposes. Local unit leadership should be particular aware of these prohibitions since even unintentional violations are not excusable.

The prohibition against the use of union and employer funds applies to any employer, not just Local 2320 or the employers with whom Local 2320 has collective bargaining agreements.

All candidates have been notified and briefed on these legal prohibitions in an effort to avoid potential problems.
